Terms of Service

1. Acceptance of Terms
By accessing or using the Pimpeando platform, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the service. These terms apply to all users, clients and persons who access or use the service.
2. Description of Service
Pimpeando is a SaaS (Software as a Service) product information management (PIM) platform that offers: • Centralization and management of product catalogs • AI-powered content enrichment • Synchronization with e-commerce platforms (VTEX, Shopify, Amazon, MercadoLibre, SAP B1, and others) • SEO auditing and content optimization • Digital Asset Management (DAM) • Catalog reporting and analytics The service is provided "as-is" and may be updated, modified or discontinued with prior notice.
3. User Accounts and Responsibilities
When creating an account on Pimpeando, you are responsible for: • Maintaining the confidentiality of your access credentials • All activities carried out under your account • Notifying us immediately of any unauthorized use • Providing accurate and up-to-date information during registration We reserve the right to suspend or cancel accounts that violate these terms.
4. Acceptable Use
The following are strictly prohibited: • Automated scraping or mass data extraction from the platform • Attempting to access other customers' systems or data • Using the service for illegal or fraudulent activities • Reselling, sublicensing or redistributing the service without written authorization • Reverse engineering or attempting to obtain the source code • Intentionally overloading the service infrastructure (DoS/DDoS attacks) • Introducing viruses, malware or malicious code Violation of these restrictions may result in immediate termination of service without refund.
5. Subscriptions, Billing and Cancellation
Plans and billing: • Subscriptions are billed monthly or annually depending on the chosen plan • Prices are expressed in USD and may vary based on applicable local taxes • Payment is processed through Stripe; we do not store credit card data Cancellation: • You may cancel your subscription at any time from the settings panel • Cancellation is effective at the end of the current billing period • No refunds are issued for the current period at the time of cancellation • Catalog data will be available for 30 additional days after cancellation Free trial: • The 90-day trial does not require a credit card • At the end of the trial period, access is suspended until a plan is selected
6. Intellectual Property
Pimpeando's property: • The platform, software, interfaces, design and technology are the exclusive property of Pimpeando • All rights not expressly granted in these terms are reserved • The name "Pimpeando", associated logos and brands are registered trademarks Customer's property: • Catalog data, images and content you enter into the platform are and will remain your property • You grant us a limited license to process, store and display your content solely for the purpose of providing the service • Upon account cancellation, you may export your full catalog in CSV/JSON format before final closure
7. Limitation of Liability
To the maximum extent permitted by applicable law: • Pimpeando shall not be liable for indirect, incidental, special, consequential or punitive damages • Pimpeando's total liability for any claim shall not exceed the amount paid for the service in the 3 months prior to the event giving rise to the claim • We do not guarantee that the service will be uninterrupted, error-free or completely secure • AI-generated content is advisory; the customer is responsible for reviewing and approving before publishing
8. Availability and SLA
We are committed to maintaining 99.5% monthly service availability (excluding scheduled maintenance). In the event of significant outages, a proportional service credit may be applied based on downtime. Scheduled maintenance will be notified with at least 24 hours' notice.
9. Confidentiality
Both parties agree to maintain the confidentiality of information marked as confidential or which, by its nature, should be treated as such. This obligation extends for 3 years after termination of service. E-commerce platform access credentials stored in Pimpeando are encrypted with AES-256-GCM and are not accessed except to perform synchronizations authorized by the customer.
10. Modifications to the Service and these Terms
We may modify these terms at any time. Significant changes will be notified by email with at least 30 days' notice. Continued use of the service after notification constitutes acceptance of the new terms. We may also update, add or remove service features with or without prior notice, although we will endeavor to communicate relevant changes.
11. Governing Law and Jurisdiction
These terms are governed by the laws of the United Mexican States. For users in the European Union, the mandatory consumer protection provisions of their country of residence additionally apply. Any dispute will preferably be resolved through mediation. In the event of litigation, the parties submit to the jurisdiction of the competent courts of Mexico City, Mexico.
